Federal Court Mandates Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks legal authority.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.

The situation originates in a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to face human smuggling charges, he was held in immigration detention.

In her order, the court pointed out that the government does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Context of the Legal Challenge

The court proceedings center on conflicting assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in Tennessee.

The judge, who was hearing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
